Terms of Service
Last updated: 28 October 2026
These Terms of Service ("Terms") govern your use of Bitlane: the website bitlane.co, the dashboard at app.bitlane.co, the API, the search engines we host, the search widget and the plugins and modules for online stores (together, the "Service").
Bitlane is built and operated by NMC Soft ("we", "us"); our details are in section 12.
By creating an account or using the Service you accept these Terms. If you use the Service for a company, you accept them on its behalf and confirm you may do so; "you" then means that company. Purchases are also governed by the Terms of Sale, and personal data by the Privacy Policy.
1. The Service
Bitlane is a managed search service for online stores and websites. We host search engines for you, keep them running and up to date, and provide a dashboard, an API, a search widget, analytics on searches and their results, and integrations with store platforms.
The Service is meant for businesses and professionals. We may improve and change it over time; if we remove a feature that is central to a paid plan, we tell you in advance.
2. Your account
- You must give accurate information and keep it up to date, and be at least 18 years old.
- Keep your password, two-factor codes, API keys and the engines' master keys secret. You are responsible for what happens with your account and keys; tell us at once if you think they have been misused.
- You can invite team members to your projects and give them roles. You are responsible for who you invite and for what they do.
- The owner of a project chooses and pays its plan.
3. Your content
"Your content" is everything you or your systems send to the Service: documents and records you index, settings, and the search and event data that your website's visitors generate through your engines and widget.
- You own your content. You give us only the rights needed to host, process, index, back up and display it in order to provide the Service to you.
- You are responsible for your content and for having the right to send it to us, including the personal data in it and any notices or consents your visitors need (for example, before enabling the widget's analytics).
- You can export your documents at any time through your engines' API.
4. Acceptable use
You must not use the Service to:
- break the law, or store or distribute content that is illegal, infringes the rights of others, or is malicious (malware, phishing);
- send spam, or harvest data from others;
- attempt to access other customers' data, probe or test the Service's security without our written permission, or bypass limits, quotas or billing;
- overload the Service on purpose, or use it in a way that harms its stability for others;
- resell or offer the Service as a standalone search hosting product without our agreement.
We may suspend an engine, a project or an account that breaks these rules or puts the Service or other customers at risk. Unless the risk is urgent, we warn you first and give you time to fix the problem.
5. Availability and support
We run the Service on Google Cloud in the European Union and work to keep it available and fast, but we do not promise uninterrupted service unless a separate agreement with you says so. Planned maintenance is done to avoid downtime where possible (engine and server upgrades are made without interrupting search).
If the Service is unavailable for a significant time because of a failure on our side, contact us: we will credit or refund the affected time as described in the Terms of Sale.
Support is by email and through the contact form, in English and Italian.
6. Data protection
When you use the Service, two roles apply:
- For your account data (you and your team members), we are the controller, as described in the Privacy Policy.
- For the personal data in your content (for example your visitors' searches, clicks and orders recorded through the widget and the integrations), you are the controller and we are your processor, under our Data Processing Agreement, which is part of these Terms. The providers we use are listed on the Sub-processors page.
7. Intellectual property
The Service, its software, design and brand belong to Bitlane or its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service, the widget and the integrations for your own websites and stores while your account is active.
If you send us feedback or suggestions, we may use them freely.
8. Ending the Service
You can stop using the Service and delete your projects at any time, and ask us to delete your account. When a paid plan ends, your data is kept and then deleted as described in the Terms of Sale.
We may end these Terms or close an account with 30 days' notice, or immediately for a serious breach of these Terms (for example of section 4) or when required by law. If we close an account without a breach on your side, we refund the unused part of the period already paid.
9. Warranties and liability
Except as stated in these Terms, the Service is provided "as is". We do not guarantee that search results will meet a particular business result.
To the extent permitted by law:
- neither party is liable for indirect or consequential damages, such as lost profits, revenue or data, arising from these Terms;
- our total liability for any claim related to the Service is limited to the amounts you paid us in the 12 months before the event that gave rise to the claim.
These limits do not apply to liability that cannot be limited by law, such as for fraud, wilful misconduct or gross negligence.
You will indemnify us against claims of third parties arising from your content or from using the Service against these Terms.
10. Changes to these Terms
We may update these Terms. The date at the top shows the current version. We announce changes that reduce your rights by email at least 30 days before they take effect; if you don't agree, you can stop using the Service and cancel your plan before then.
11. Law and disputes
These Terms are governed by the law of the Republic of Albania, and disputes are settled by the competent courts of Tirana. Before going to court, write to us: we will try to settle any dispute amicably. If you are a consumer, you also keep the protection of the mandatory rules and the courts of the country where you live.
If a provision of these Terms is found invalid, the rest stays in force. Not enforcing a provision does not waive it.
